Welcome to Niyo Jewelle. These Terms of Service (“Terms”, “Terms of Service”) govern your access to and use of the Niyo Jewelle website, online store, products, services, content, features and related services (collectively, the “Services”).

In these Terms, “Niyo Jewelle”, “we”, “us” and “our” refer to Niyo Jewelle, the business operating this online store.

Niyo Jewelle is powered by Shopify, which provides the ecommerce platform that enables us to offer our products and Services to you. However, purchases made through our online store are transactions between you and Niyo Jewelle.

However, actual product appearance may vary slightly due to:

screen resolution and device settings;
lighting and photography conditions;
natural variations in gemstones, metals and jewellery;
handcrafted or artisan manufacturing processes; and
other factors beyond our reasonable control.

For jewellery products, minor variations in dimensions, finish, texture, weight or appearance may occur, particularly where products are handcrafted.

Product images are intended to provide a visual representation and may not always reflect the exact physical size of an item.

Where product specifications such as metal purity, weight, stone details, hallmarking or HUID are provided, such information will be based on the applicable product records and available certification or compliance information.

We reserve the right to:

modify product descriptions;
update product specifications;
discontinue products;
correct errors;
limit quantities;
restrict sales to certain locations; or
refuse or cancel an order where reasonably necessary.

AI-Generated Model and Promotional Images

Niyo Jewelle may use AI-generated models and digitally created or enhanced lifestyle imagery to present jewellery in a styled or worn setting.

Such imagery is intended to demonstrate styling and presentation. The model, background, pose, lighting, and other visual elements may not represent a real photograph of a person wearing the jewellery.

The jewellery product itself is described in the relevant product listing. Customers should review the listed specifications and product information before placing an order.

Niyo Jewelle will take reasonable care to ensure that promotional imagery does not materially misrepresent the actual jewellery. This provision does not exclude or restrict any consumer rights available under applicable law.

SECTION 3 — JEWELLERY, HALLMARKING AND PRODUCT AUTHENTICITY

For applicable precious-metal jewellery, Niyo Jewelle will provide relevant product information and documentation in accordance with applicable laws and regulations.

Where applicable, jewellery may carry or be accompanied by relevant hallmarking, purity, HUID or certification information.

Customers should carefully review the product description and accompanying documentation provided with their purchase.

Hallmark, HUID and certification information applies to the specific jewellery article for which it is issued and should not be interpreted as a general certification covering other products.

Niyo Jewelle does not permit customers to alter, remove, tamper with or misuse product identification, hallmark, HUID, certification or other authenticity information.

Any alteration, resizing, engraving, polishing, repair or other modification after delivery may affect eligibility for return, exchange, refund or warranty-related claims, subject to our applicable policies and applicable law.

SECTION 4 — ORDERS AND ACCEPTANCE

When you place an order through our website, you are submitting a request to purchase the selected products.

An order acknowledgement or confirmation email confirms that we have received your order. It does not necessarily mean that the order has been finally accepted for fulfilment.

Niyo Jewelle reserves the right to accept, reject, limit or cancel an order for reasonable reasons, including:

product availability;
pricing or listing errors;
suspected fraud or unauthorized transactions;
incorrect customer or shipping information;
payment failure;
duplicate or unusually large orders;
technical errors;
inability to fulfil the order; or
circumstances beyond our reasonable control.

If we cancel an order after payment has been received, we will initiate the applicable refund in accordance with our Refund Policy and applicable payment-provider timelines.

You should carefully review your order before completing checkout.

Once an order has entered processing, cancellation may not be possible, particularly for customized, personalized, engraved, resized or made-to-order jewellery.

SECTION 5 — PRICES, TAXES AND BILLING

All prices displayed on the website are subject to change without prior notice.

The applicable price for a product will generally be the price displayed at the time the order is successfully placed, subject to correction of obvious pricing or technical errors.

Applicable taxes, including GST, will be charged as required under applicable law and may be reflected separately or included in the displayed price depending on the applicable website configuration.

Shipping or other applicable charges may be added during checkout.

Promotional offers, discounts and coupon codes may be subject to additional terms and conditions.

Unless expressly stated otherwise:

promotional discounts cannot be exchanged for cash;
multiple promotional codes may not be combined;
offers may have limited validity;
offers may be withdrawn or modified; and
promotional terms will apply to eligible orders.

You agree to provide accurate and complete billing and payment information.

You authorize the applicable payment provider to process the payment associated with your order.

SECTION 6 — PAYMENT

Niyo Jewelle does not ordinarily store complete card information such as full credit/debit card numbers or CVV details on its own systems.

Payment processing may be subject to the terms, privacy policies and security procedures of the relevant payment service provider.

We may cancel or place an order on hold where a payment is unsuccessful, reversed, disputed, suspicious or otherwise not successfully authorized.

For Cash on Delivery orders, additional conditions, verification procedures, order-value limits or service-area restrictions may apply.

SECTION 7 — SHIPPING AND DELIVERY

Niyo Jewelle may use third-party logistics providers, courier companies, shipping aggregators or other delivery partners to fulfil orders.

Delivery estimates displayed on the website or communicated by us are indicative and may vary depending on:

destination;
courier availability;
weather;
public holidays;
operational disruptions;
customs or regulatory requirements, where applicable;
incorrect or incomplete shipping information;
remote or restricted delivery locations; and
events beyond our reasonable control.

A delay by a delivery partner does not automatically constitute a breach of these Terms.

Customers are responsible for providing accurate delivery information, including name, address, PIN code and contact details.

If an order cannot be delivered because incorrect or incomplete information was provided by the customer, additional delivery charges or re-shipping requirements may apply.

SECTION 8 — DELIVERY, RISK AND INSPECTION

Customers should inspect jewellery packages carefully upon delivery.

For high-value jewellery orders, customers are strongly encouraged to record an uninterrupted unboxing video showing:

the sealed package;
the shipping label;
the condition of the outer packaging;
the opening of the package; and
the product and accompanying documentation.

Where a product appears damaged, incorrect or tampered with, customers should contact support@niyojewelle.com as soon as possible and preferably within the reporting period specified in our Return & Refund Policy.

Nothing in these Terms limits any rights or remedies available to consumers under applicable law.

SECTION 9 — RETURNS, REFUNDS AND EXCHANGES

Returns, refunds, cancellations and exchanges are governed by our applicable Return & Refund Policy and Cancellation Policy.

Jewellery must satisfy the relevant eligibility conditions before a return, refund or exchange can be approved.

For jewellery, we may inspect:

product identity;
product condition;
weight;
purity;
hallmark/HUID details where applicable;
certificates;
tags;
packaging;
accessories;
signs of wear or use;
resizing or alteration;
engraving;
damage; and
other relevant product characteristics.

Where applicable, refunds will be processed after the returned product has been received and inspected.

Our policies do not limit any mandatory consumer rights available under applicable Indian law.

SECTION 10 — CUSTOM AND PERSONALIZED JEWELLERY

Certain jewellery may be customized, personalized, engraved, resized, altered or manufactured specifically according to customer instructions.

Such products may not be eligible for cancellation, return, exchange or refund once production or customization has commenced, except where required by applicable law or where the product is defective, damaged, incorrect or otherwise fails to conform to the agreed order.

Before placing a customized order, customers should carefully verify:

size;
measurements;
engraving text;
personalization details;
product specifications;
metal type;
gemstone details; and
other customization instructions.

Niyo Jewelle is not responsible for customer-provided customization information that was submitted incorrectly, subject to applicable law.

SECTION 11 — INTELLECTUAL PROPERTY

All content available through the Services, including but not limited to:

Niyo Jewelle name and branding;
logos;
product names;
product photographs;
jewellery designs where applicable;
graphics;
text;
descriptions;
videos;
audio;
website layouts;
icons;
illustrations;
software;
product information; and
other materials

is owned by, licensed to, or otherwise lawfully used by Niyo Jewelle and is protected by applicable intellectual property laws.

You may access and use the website for personal and lawful shopping purposes.

You must not, without our prior written permission:

copy or reproduce our content;
download or commercially exploit product photographs;
reproduce jewellery designs or creative materials;
modify or create derivative works;
redistribute website content;
use our branding or trademarks;
scrape or systematically collect website content; or
use our content for commercial purposes.

Niyo Jewelle and associated branding are proprietary to the applicable rights holder.

Nothing in these Terms grants you ownership or a licence to use our intellectual property except as expressly permitted.

Niyo Jewell retains all rights not expressly granted under these Terms.

SECTION 12 — CUSTOMER REVIEWS AND FEEDBACK

If you submit reviews, photographs, comments, suggestions, testimonials, feedback or other content (“Feedback”) to Niyo Jewelle, you represent that:

the content is truthful to the best of your knowledge;
you have the necessary rights to submit it;
it does not infringe another person's rights;
it does not contain unlawful, defamatory, abusive or misleading material;
it does not contain malicious software; and
it does not violate these Terms.

By submitting Feedback, you grant Niyo Jewelle a non-exclusive, royalty-free, worldwide licence to use, reproduce, display, publish, adapt and distribute that Feedback for legitimate business purposes, including website presentation, marketing and promotional activities, subject to applicable law.

We may moderate, edit or remove Feedback where reasonably necessary, including where it is unlawful, misleading, offensive, fraudulent, defamatory or otherwise violates these Terms.

However, the purchase of products through our store is a transaction between you and Niyo Jewelle.

Shopify is not the seller of Niyo Jewelle products and is not responsible for:

the products sold by Niyo Jewelle;
product quality;
product descriptions;
fulfilment;
returns;
refunds;
exchanges;
customer service;
shipping arrangements; or
disputes arising directly between you and Niyo Jewelle regarding your purchase.
